New Canadian Citizenship Rules Could Benefit More LGBTQ+ Families Born Abroad

Updated Citizenship Law Expands Opportunities for Many Families

Canada’s updated Citizenship Act has expanded citizenship by descent for many people born outside the country, creating new opportunities for families who were previously excluded under the former first-generation limit.

For some LGBTQ+ families, these legislative changes may allow children born abroad to qualify for Canadian citizenship through a Canadian parent, even if earlier citizenship rules prevented them from doing so. The changes are part of Bill C-3, which came into force on December 15, 2025.

How the Previous Rules Affected Some Families

Before the introduction of Bill C-3, Canadian citizenship by descent was generally limited to the first generation born outside Canada.

As a result, some children born abroad to Canadian citizens who had themselves acquired citizenship by descent were unable to automatically receive Canadian citizenship. This affected families in a variety of circumstances, including some LGBTQ+ families who relied on assisted reproduction, surrogacy, adoption, or international family-building arrangements.

What Has Changed?

Under the updated legislation, many individuals born before December 15, 2025, who can demonstrate an unbroken line of descent from a Canadian citizen may now automatically be Canadian citizens under the amended Citizenship Act.

Eligible individuals generally apply for a Proof of Canadian Citizenship (Citizenship Certificate) to obtain official confirmation of their citizenship status.

Why This Is Important for LGBTQ+ Families

Modern families are formed in many different ways, including through:

  • Assisted reproductive technologies.
  • Surrogacy arrangements. 
  • Adoption.
  • Donor conception.
  • Same-sex marriages and partnerships.

The updated citizenship legislation may benefit some LGBTQ+ families whose children were previously affected by the former first-generation limit on citizenship by descent.

However, eligibility is not determined by sexual orientation or gender identity. Instead, IRCC assesses each application based on the applicable provisions of the Citizenship Act, the legal parent-child relationship, the individual’s date of birth, and the supporting documentation provided.

Documentation Remains Essential

Applicants seeking Proof of Canadian Citizenship should be prepared to provide official documents that establish their eligibility.

Depending on the circumstances, these may include:

  • Canadian birth or citizenship records of the Canadian parent or ancestor.
  • Birth certificates.
  • Adoption orders, where applicable.
  • Court or legal parentage documents, if relevant.
  • Marriage certificates or other supporting civil records.
  • Additional documents requested by Immigration, Refugees and Citizenship Canada (IRCC).

Providing complete and accurate documentation can help reduce delays during application processing.

Children Born on or After December 15, 2025

The updated legislation also introduced a new requirement for certain future generations.

For some children born or adopted outside Canada on or after December 15, 2025, to a Canadian parent who also obtained citizenship by descent, the Canadian parent will generally need to demonstrate a substantial connection to Canada, including 1,095 cumulative days (three years) of physical presence in Canada before the child’s birth or adoption.

What This Means for Families

Families who previously believed their children were ineligible for Canadian citizenship may now wish to review their circumstances under the updated Citizenship Act

Because citizenship eligibility depends on the facts of each individual case, applicants should carefully review their family history and ensure they have the necessary supporting documentation before submitting an application.
